These Terms of Service (“Terms”) are an agreement between you and My Digital Human, Inc. (“My Digital Human,” “we,” “us”) and govern your use of the My Digital Human app and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
The short version
You must be 18 or older.
You may only make a twin of yourself, never of anyone else.
Twins are AI. They can be wrong, and they are not the real person.
Calls are recorded, and twin owners can see replays, transcripts and summaries.
No impersonation, sexual content, or harassment. Report anything that breaks these rules.
You must be at least 18 years old and able to form a binding contract. By using the Service you confirm that you are.
You may not use the Service if we have previously banned you, or if the law where you live doesn’t allow it.
You are responsible for your account and everything done with it. Keep your sign-in secure, give us accurate information, and tell us right away if you think someone else is using your account. One person, one account, one twin.
2. What the Service is
My Digital Human lets you create a live video AI twin of yourself from a live selfie and a short voice recording, shape it with a bio and documents, share it with others, and talk face to face with twins and AI personas on live video calls. Other members can call your twin if it is public or if they have your invite link. We may change, add or remove features over time.
3. Only make a twin of yourself
Your twin must be made from your own face and your own voice, captured live in the app. You may not create a twin of any other person, living or dead, including a public figure, celebrity, friend, family member or client, even if you say you have their permission.
You may not use recordings, photos, screens, masks, voice changers or other tricks to make a twin of someone else, and you may not alter or reuse another member’s twin, avatar or voice.
You agree to our likeness and voice consent before your face and voice are captured. You confirm everything in that consent is true.
4. Your likeness and content
You own your likeness and content
You keep all rights you have in your name, face, voice and likeness, and in the bio, documents, messages and other content you provide (“Your Content”).
License you give us
So that we can run your twin, you grant My Digital Human a non-exclusive, worldwide, royalty-free, sublicensable (only to our service providers) license to use, copy, store, process, adapt and display your name, face, voice and likeness, the AI avatar and voice clone made from them, and Your Content, to:
create, host, operate and display your twin within the Service;
let your twin appear and speak, in your likeness and voice, on calls with people who can reach it under your settings (public directory or invite link);
record calls and create transcripts, summaries and memories as described in the Privacy Policy; and
keep the Service safe and enforce these Terms.
We will not use your face, voice or twin in advertising or marketing outside the Service, or to train general-purpose AI models, without your separate written permission. This license ends when you delete your twin or your account, except for copies we keep as described in the Privacy Policy (for example, records of calls that other members are entitled to keep until they delete them, or records we must keep by law).
Your responsibilities for Your Content
You are responsible for Your Content and for what your bio and documents instruct your twin to say. You confirm you have the rights to upload any documents you give your twin, and that they don’t contain other people’s private or confidential information without permission.
5. Calls are recorded
Every call with another member’s twin or a featured AI persona is recorded, and the app shows a recording notice that you must accept before the call starts. Calls create a video replay, a transcript and an AI summary.
The twin’s owner can watch replays and read transcripts and summaries of calls to their twin, and callers can see transcripts of their own calls.
By starting or answering a call, you consent to it being recorded. Don’t let anyone else speak on a call unless they are 18 or older and also agree to be recorded.
You may use recordings, transcripts and summaries only for your personal use of the Service. Don’t publish, sell or share another member’s call recordings or transcripts outside the Service without their permission.
6. AI output
Twins are AI, not people. A twin is an AI that looks and sounds like its owner. It is not the owner, and the owner is not on the call. Every call is labeled “AI twin of [name]” or “AI assistant.”
Twins can be wrong. AI output can be inaccurate, incomplete, outdated or offensive, and a twin may say things its owner never said and wouldn’t say. Web search results come from third-party websites we don’t control.
Twins can’t make commitments. Nothing a twin says is a promise, agreement, offer, endorsement or statement by its owner or by My Digital Human. A twin can’t enter contracts, give consent or accept money on anyone’s behalf.
Not professional advice. Don’t rely on any twin or persona for medical, legal, financial, mental health or other professional advice, or in an emergency. In an emergency, call your local emergency number.
You are responsible for how you use AI output. Evaluate it before you rely on it.
7. Prohibited content and conduct
You may not use the Service, your twin, your bio or your documents to:
Impersonate anyone: create a twin of anyone but yourself; pretend to be another person, organization or brand; or tell people that a twin is a real human, or that it is the owner speaking live.
Create or seek sexual content: sexually explicit or pornographic content, nudity, or sexual role-play. Any sexual content involving minors is strictly forbidden; we will remove it, ban the account and report it to the National Center for Missing & Exploited Children and law enforcement.
Harass, bully or threaten anyone, or promote violence, self-harm, hate or discrimination against people based on protected characteristics.
Defraud or scam people, phish for passwords or money, or carry out spam or unwanted solicitation.
Deceive people about elections, public health or emergencies, or create misleading content about real people.
Share other people’s private information, or record people who haven’t agreed to be recorded.
Infringe anyone’s copyright, trademark, privacy, publicity or other rights.
Do anything illegal, or encourage others to.
Interfere with the Service: hack, probe or bypass security, usage limits or safety features; reverse engineer the app except where the law allows; access the Service with bots or scrapers; extract or copy other members’ twins, avatars, voices or data; or overload our systems.
Use the Service to build a competing product, or resell or sublicense access to it.
We may remove content, limit features, hide a twin from the directory, or suspend or ban accounts that we believe break these rules, with or without notice.
8. Reporting and blocking
Report or block a twin by long-pressing it in the Contacts tab. You can report it as inappropriate or offensive, impersonation, harassment, spam or scam, or other. Blocking stops calls between you in both directions.
Someone made a twin of you? Report it in the app as “Impersonation” and email us at randy@mydigitalhuman.com with the subject “Likeness complaint.” Tell us the twin’s name and how to reach you. We may ask you to verify your identity. We aim to remove impersonating twins quickly.
We may review reports and decide what action, if any, to take. We are not required to monitor content or act on every report, and we don’t guarantee that we will catch every violation.
9. Our rights and copyright complaints
The Service, including our software, design, AI personas, and the names and logos “My Digital Human” and “Miles,” belongs to My Digital Human and its licensors. We give you a personal, revocable, non-exclusive, non-transferable license to use the app on Apple devices you own or control, under these Terms. If you send us feedback, we may use it freely without paying you.
If you believe content on the Service infringes your copyright, email us at randy@mydigitalhuman.com with: your contact information; a description of the work; where the material is in the Service; a statement that you believe in good faith the use isn’t authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove the material and terminate repeat infringers.
10. Third-party services
The Service relies on third-party providers, such as Apple, Google (Firebase) and the AI and video providers named in our Privacy Policy, and may show content from third-party websites through web search. We are not responsible for third-party services or content, and your use of Apple or Google sign-in is also subject to their terms.
11. Beta features and fees
The Service is currently in early access, including through Apple’s TestFlight. Beta features may be unstable, change, have usage or call-length limits, or be removed, and we may reset or limit test accounts. The Service is currently free. If we introduce paid features, we will tell you the price and terms before you are charged, and purchases in the app will be handled by Apple.
12. Ending your account
You can stop at any time. Delete your twin or your account under Me › Account & Settings. Account deletion is permanent.
We can suspend or end your access, or remove your twin, if you break these Terms, if we must for legal reasons, if your use creates risk for others or for us, or if we stop offering the Service. Where reasonable, we will tell you why.
Sections 4 (responsibilities and retained copies), 6, 9, 13, 14, 15, 16 and 18 continue after your account ends.
13. Disclaimers
The Service, including all twins, personas and AI output, is provided “as is” and “as available.” To the fullest extent the law allows, My Digital Human disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the Service will be uninterrupted, secure or error-free, that any twin will look or sound exactly like its owner, or that calls will connect or be recorded.
14. Limitation of liability
To the fullest extent the law allows, My Digital Human and its officers, directors, employees, licensors and providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or reputation, arising from or related to the Service, AI output, or content or conduct of other members, even if we were told they were possible. Our total liability for all claims related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or one hundred U.S. dollars (US $100).
Some places don’t allow these limits, so they may not fully apply to you. Nothing in these Terms limits liability that can’t be limited by law.
15. Indemnity
To the extent the law allows, you will defend and hold harmless My Digital Human and its officers, directors and employees from claims, losses and costs (including reasonable lawyers’ fees) arising from Your Content, your twin, your misuse of the Service, or your violation of these Terms or anyone’s rights.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought only in the state or federal courts located in Delaware, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small claims court where it qualifies. Before filing a claim, please email us so we can try to resolve it informally within 30 days. If you live in a place whose laws give you the right to bring claims where you live, or that apply local consumer protections, these Terms don’t take away those rights.
17. Apple App Store terms
If you got the app from Apple’s App Store or TestFlight: (a) these Terms are between you and My Digital Human only, not Apple, and My Digital Human, not Apple, is responsible for the app and its content; (b) Apple has no obligation to provide maintenance or support for the app; (c) if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price you paid for the app, and to the maximum extent the law allows, Apple has no other warranty obligation for the app; (d) My Digital Human, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims; (e) My Digital Human, not Apple, is responsible for investigating, defending, settling and discharging any third-party claim that the app infringes intellectual property rights; (f) you confirm you are not in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and you are not on any U.S. government list of prohibited or restricted parties; (g) you must also follow applicable third-party terms, such as your wireless data service agreement; and (h) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also follow Apple’s Usage Rules in the App Store Terms of Service.
18. General
Changes. We may update these Terms. We will post changes here and update the date above, and for material changes we will notify you in the app or by email before they take effect. If you keep using the Service after changes take effect, you accept them.
Entire agreement. These Terms, the Privacy Policy and the likeness and voice consent you agree to in the app are the whole agreement between you and us about the Service.
Severability and waiver. If any part of these Terms is unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver.
Assignment. You may not transfer these Terms. We may transfer them in connection with a merger, acquisition or sale of assets.
No agency. Nothing in these Terms creates a partnership, employment or agency relationship.
